NEWS: Bihar Gov. dismisses 3 judges for gross misconduct

Bihar Government issued a notification dated December 21st dismissing 3 judicial officers of lower judiciary from their service for being found guilty of misconduct. The three officers were caught red handed by Nepal police in a Nepali hotel in objectionable state with women back in January, 2013.

‘Udghosh’, a Nepali newspaper first flagged this report that these officers were caught in an improper state in a police raid in Metro hotel of Biratnagar with several Nepali women. They somehow managed to get released after that incident.

The name of 3 Judges who got dismissed are Hari Niwas Gupta (Samastipur), Komal Ram (Araria) and Jitendra Nath Singh (Araria). There deposing from service will be effective from February, 2014 and they shall be debarred from entitlement to any kind of allowances, pensions and salaries since the date mentioned above. Actions were initiated against them by State government from February 12, 2014, on the recommendation of the Patna high court.

The Patna high court had first taken cognizance of the matter by the report published in the Nepali newspaper and Purnia district and session court had started the inquiry. The report which was submitted in the Patna high court said that the Nepali daily had asked for apology about this matter in one of their report. The high court asked the Union Ministry of home affairs to intervene in the given matter.

The State government was allowed to take decisions on the recommendation of Patna High court and the 3 convicted judicial officers could challenge the decision once it was formally made by government.

On December 17, 2020, Bihar Government notified the dismissal of alleged 3 judicial officers from their services.
