NEWS: Delhi HC Reserves Order in ED & CBI seeking early Hearing in 2G Spectrum Appeal

Delhi High Court has reserved order in application moved by Enforcement Directorate and CBI seeking early hearing in 2G Spectrum appeals.

The Single Judge bench by Justice Brijesh Sethi reserved the order after hearing all the parties.

Court Said:

We will just do our duty, the outcome is not in our hands”

Beforehand Court had allowed the ED to move an application for seeking an urgent hearing on Leave to Appeal filed against the acquittal of A Raja and others in the 2G Spectrum case.

ASG Sanjay Jain, appearing for the ED, argued that the judge who had heard the case so far is going to retire in November, so the hearing in matter shall be expedited. Therefore Mr. Jain asked the court to list the hearing in 3-4 weeks, he said:

“One of the biggest trails was conducted as per the direction of Supreme Court on the large expense of public exchequer. Therefore, the public interest lies in seeing this matter reaching its logical conclusion. Any delay in this matter would further burden the public exchequer.”

Whereas counsel of A Raja (Respondent), had opposed the application for early hearing on the ground that it doesn’t serve the public interest, the agency have not given any reason for this urgency, and it would be very difficult in the situation of Pandemic for the fair representation.

In December 2017, A Raja and others were acquitted by a Special CBI judge in both the ED and CBI cases.

Challenging the Order of Special Judge, both ED and CBI had approached the Delhi High Court in March 2018.
