Allahabad HC says Cow should be Declared as National Animal, given Fundamental Rights

The Allahabad High Court while denying bail to the accused charged for offences under the Prevention of Cow Slaughter Act in Uttar Pradesh, observed that the cow is a part and parcel of the culture of India and should be declared a National Animal.

“The work of cow protection is not only of one religious sect, but cow is the culture of India and the work of saving the culture is of every citizen living in the country irrespective of religion,” the Court said.

The Single Judge Bench of Justice Shekhar Kumar Yadav said that government should bring a bill in the Parliament to give fundamental rights to cow and to declare it as the national animal. Strict laws should be made to punish those who talk about harming cow.

The Applicant Javed was charged under Sections 3, 5 and 8 of the Prevention of Cow Slaughter Act.

He had applied for bail to which the court denied and remarked that India is the only country in the whole world where people of different religions live, who may worship differently but their thinking is the same for the country.

While the court also stated that if bail is granted to Javed, it might disturb the harmony of the society at large.

‘This is not the first offence of the applicant, even before this he has committed cow slaughter, which has disturbed the harmony of the society and if released on bail, he will again do the same work which will spoil the harmony in the society. This bail application of the above applicants is baseless and deserves to be rejected. Accordingly, the above bail applications are rejected,” the court said.
