To take the subject of cybercrimes, CIDs[4] (Criminal Investigation Departments) of several towns started up Cyber Crime Cells in various cities. The Information Technology Act of India says clearly that when cybercrime has been performed, it has global control or jurisdiction. And therefore, a complaint can be registered at any cyber cell.

With the rise in the use of the Internet, it is clear that there will be frauds for unnecessary use as well. Instead of the unnecessary use, certain crimes online are also committed, and therefore, for the security of the victim, it is essential to have provisions for recording the complaint and suggesting the officials about the commission of the crime for sentencing the accused.

Step 1

One can present a complaint about cybercrime, both offline and online. Cyber Cell India is the authority that deals with the online and offline cyber complaint, and hence, the first step is to communicate the complaint to this authority. One can also give a call on cyber crime helpline number.

But since cybercrime comes under the purview of the global control, therefore, it is assumed from this that one can file a cyber complaint in the cybercrime cell of any city irrespective of the fact that the person begins from some other cities in India.

Step 3

The following information is needed to be given by the victim at the time of registering the complaint with the cyber cell-

Name of the victim/person filing the complaint,

His contact particulars,

Address for mailing.

The written complaint shall be addressed to the head of the department.

Step 4

In case of no entrance to the cyber cell India, one can report the stuff to the local police station by filing a First Information Report. If the complaint due to any reason does not get accepted in the police station, then, in that case, one can request the judicial magistrate or the commissioner.

Step 5

One can also file a First Information Report under the provision of the Indian Penal Code if the crime falls under this Code. It is the responsibility of every police officer to complain as it has been made obligatory under section 154 of the Code of Criminal Procedure.
