The Supreme Court Bar Association (SCBA) has recently passed a resolution condemning the lathi charge against lawyers at the Ghaziabad District Court, Uttar Pradesh. The incident, reportedly carried out at the behest of District & Sessions Judge Anil Kumar-X, has drawn severe criticism from the SCBA, which has demanded accountability and immediate action.
Resolution Passed by SCBA
- The SCBA resolution expresses strong disapproval of the police brutality faced by advocates during the lathi charge in Ghaziabad.
- It calls for immediate intervention from the Allahabad High Court and the Uttar Pradesh Government to investigate the matter.
- The SCBA stated: “The Supreme Court Bar Association will not tolerate any attack on the prestige of advocates and demands immediate action.”
SCBA’s Demands
The SCBA has outlined several key demands in its resolution, which include:
- Inquiry into District Judge’s Conduct:
- An investigation into the actions of Mr. Anil Kumar-X, the District & Sessions Judge of Ghaziabad, is to be conducted by a sitting judge of the Allahabad High Court, headed by the Chief Justice and the Administrative Judge responsible for overseeing Ghaziabad.
- Accountability of Guilty Officials:
- Ensure the responsible district judge and police officers face justice for their roles in the lathi charge incident.
- Dismissal of Officials Involved:
- Demand the dismissal of Judge Anil Kumar-X and the police officers responsible for ordering or executing the lathi charge.
- Compensation for Injured Advocates:
- Seek compensatory measures for the lawyers injured during the incident.
- Implementation of Advocates Protection Act:
- Urge the enactment of an Advocates Protection Act to prevent similar incidents and ensure the safety of advocates and their families.
- Improvement of Law and Order:
- Call for measures to enhance the law and order situation in Uttar Pradesh, ensuring police accountability.
Appeal to Bar Councils
- The SCBA has also urged the Bar Council of India and all State Bar Councils to protect advocates’ rights and prevent any form of harassment.
- It stated: “Supreme Court Bar Association also calls upon the Bar Council of India and all other State Bar Councils to take necessary steps to protect the rights of advocates and to ensure that they are able to discharge their duties without fear of intimidation or harassment.”
- In its resolution, the SCBA expressed solidarity with the advocates of Ghaziabad, asserting: “Supreme Court Bar Association stands in solidarity with the advocates of Ghaziabad and pledges to do everything in its power to ensure that justice is served.
